Professional Engineering and Design Services
Fire Substation
The Fort Sill Chiricahua Warm Springs Apache Tribe (Tribe or FSAT) is issuing a Request for Proposal (RFP) from qualified, licensed engineering and design firms to furnish services for the full design and engineering of a fire substation and water fill system. This project will include vehicle circulation and fast-fill water facilities for fire rescue vehicles. The purpose of this project is to help reduce the overall response time for the FSAT reservation and the local community. This facility is to be constructed in phases. Phases one (1) and two (2), design and engineering must be included in this RFP.
Project Overview:
- Planning and design for a fire substation
- Safety vehicle housing
- Water supply system
- Ingress and egress for the frontage road
Scope of Work:
The successful firm will be responsible for coordinating both on-site and off-site development service as outlined herein as established in this RFP.
Requirements:
- The submitting firm’s engineers must hold current New Mexico State Professional Engineer’s License.
- This license must have been dully issued by the New Mexico Board of Licensure for Professional Engineers.
Phase One (1):
Supply the FSAT reservation, Luna County, and volunteer emergency with:
- rescue fire and brush truck vehicles with water to fight fires.
- primary water source will come from the wastewater treatment plant located on the FSAT reservation.
- to include but not limited to, all underground and overhead utilities
- all equipment and systems will connect to the existing wastewater treatment plant and the above-ground storage tank, which will provide water on emergency demand
- vehicle fill and staging location will require a curb cut approval and construction from NM DOT for emergency ingress and egress, and
- project requires redundancy for power and water supplies to ensure proper emergency support for rescue services.
Phase Two (2):
Designing and engineering will include a 2,500-3,500 square foot standalone reservation/community building that can house multiple fire safety equipment which will act as a staging and communication center during reservation/community crisis. Consideration is to be given to meeting and office space, equipment storage, and other areas as needed for mission support. FSAT and Luna County are committed to this project and the needs of the reservation/community. Both parties will work through agreements and procedures to reach Phase 2.
- In 2023, FSAT completed a truck stop, convenience store, and wastewater treatment facility.
- these facilities were on the reservation at Akela Flats, New Mexico in Luna County.
- New Mexico Capital Outlay Funds were utilized to evaluate existing site infrastructure plans, and
- which will help in the design and engineering for this project.
Project Timeline and Deliverables:
After awarding the project, the planning and design schedule will take approximately four months.
All resulting applications will be submitted to FSAT in a timely manner by the successful bidder, and
upon completion of the project, a final close-out report shall be submitted to FSAT documenting the
project’s completion prior to final payment.
Exhibit Scope of Work:
The scope of work attached in the exhibit shall include all engineering and architectural services, and
includes environmental, permitting, highway right-of-way acquisition, and grant administration documentation.
Numbers, Form, and Style of Proposals:
- Offerors shall provide five (5) copies of their proposal to the location specified in the RFP on or before the closing date and time for receipt of proposals.
- proposals must be typewritten on standard 8 1/2 x 11 paper and bound on the left-hand margin.
- a maximum of 15 pages, not including the front and back cover, table of contents, certification form, and campaign contribution form.
- proof of Professional Liability Insurance.
- proposal must be organized using the following format and must contain, at a minimum, all listed items in the sequential order as follows:
- Cover letter.
- Response to evaluation criteria included in this RFP, and
- other supporting or resource materials
- any proposal that does not adhere to this format and which does not address each specification and requirement within the RFP may be deemed non-responsive and rejected on this basis.
- offerors may request in writing nondisclosure of confidential data. Such data should accompany the proposal in order to facilitate eventual public inspection of the non-confidential portion of this proposal. Any request stating the entire proposal is confidential will not be acceptable. Only matters that clearly are of a confidential nature will be considered, and
- any cost incurred by the Offeror in the preparation, transmittal, and presentation of any proposal or material submitted in response to the RFP shall be borne solely by the Offeror.
Subconsultants:
- The Offeror shall list and indicate the qualifications for each subconsultant the Offeror proposes to use for any and all subcontracted work on the project.
- The Offeror is specifically advised that any person or other party to whom it is proposed to award a subcontract under this proposal must be acceptable by FSAT.
Prequalification Process:
Businesses may be pre-qualified by the Purchasing Agent as an Offeror for types of service. Lists of potential Offerors shall include, but not be limited to, such pre-qualified businesses (13-1-134 NMSA 1978).
For the purpose of this RFP, if pre-qualification is used, special instructions should be attached as an exhibit to the RFP.
Debarred or Suspended Contractors:
- A business (a contractor, subcontractor or supplier) that has either been debarred or suspended pursuant to the requirement of (13-1-177 through 13-1-180 and 13-3-11 through 13-4-17 NMSA 1978 as amended), shall not be permitted to do business with the Contracting Agency.
- Such business shall not be considered for award of the contract during the period for which it is debarred or suspended with the Contracting Agency.
Campaign Contribution Disclosure Form:
The Offeror must complete and provide a signed copy of the Campaign Contribution Disclosure Form.

Professional Liability Insurance:
The Offeror will be required to carry Professional Liability Insurance (errors and omissions).
The amount of coverage will be $1,000,000.00.
General Terms and Conditions:
- Governing Law:
This Agreement shall be governed exclusively by the laws of the State of New Mexico as the same from time to time exists.
- Independent Contractors:
Consultant and Consultant’s Agency shall not accrue leave, retirement, insurance, use of Contracting Agency vehicles or other benefits afforded to employees of the Contracting Agency as a result of this Agreement.
- Bribes, Gratuities, and/or Kickbacks:
Pursuant to (13-1-191 NMSA 1978), reference is hereby made to the criminal laws of New Mexico (30-14-1, 30-24-2, and 30-41-1 through 30-41-3 NMSA 1978) which prohibits bribes, kickbacks, and gratuities violation of which constitutes a felony. Further, the Procurement Code (13-1-28 through 13-1-199 NMSA 1978) imposes civil and criminal penalties for its violation.
- Standard Form of Agreement:
The standard form of agreement required by the funding agency or issued by the Contracting Agency will be used for this project. Copies are available and may be reviewed upon request.
- Funding:
This solicitation is subject to the availability of funds to accomplish the work.
Evaluation and Selection:
- When responses to this RFP are received, the reviewing committee shall rank the qualified firms. The highest-ranking firm will be selected, and FSAT will request a Notice of Obligation to the New Mexico Indian Affairs Department (NMIAD) for approval of the recommended firm. Upon approval, FSAT will award the firm the project for planning and design as outlined in the RFP.

This solicitation does not commit FSAT to award a contract nor to pay any costs incurred in the preparation of proposal(s) or to procure supplies. FSAT reserves the right to reject any and all proposals whether they are within the estimated total contract price or not, and to waive any informalities or irregularities in the proposals received and to re-advertise whenever such rejection or waiver is in the best interest of the FSAT. FSAT also reserves the right to conduct negotiations with the responsible and responsive firm(s) who submit qualifications/proposals found to be reasonably liked to be selected for award.

ENGINEERING DESIGN FOR IMMINENT CONSTRUCTION AND DEVELOPMENT OF FACILITIES AT THE FORT SILL-CHIRICAHUA-WARM SPRINGS- APACHE RESERVATION IN LUNA COUNTY
General
The work shall include all necessary design to support building and site in order to meet the project schedule as determined. In addition, the work shall include all meetings necessary to ensure coordination of the work with the Owner, Owner’s representative, Architect, and all other project team consultants and specialty consultants in order to provide a complete and code compliant design. Coordination meetings will occur as needed throughout the design process. Early release packages may be required.
